Section 5. Dissolution of Absolute Community Regime

Art. 99. The absolute community terminates:

(1) Upon the administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause of either spouse;

(2) When there is a decree of administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause;

(3) When the marriage is administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause; or

(4) In case of administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause during the marriage under Articles 134 to 138.

Art. 100. (2) When the administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause to any transaction of the other is required by law, administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause shall be obtained in a summary proceeding;

(3) In the absence of administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause, the separate property of both spouses shall be administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause for the support of the family. The spouse present shall, upon proper petition in a summary proceeding, be given judicial authority to administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause any specific separate property of the administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause and use the fruits or proceeds thereof to satisfy the latter's share.

Art. 101. If a spouse administer or encumber annulled or declared void any information as to his or her whereabouts conjugal dwelling consent of one spouse death judicial authorization judicial separation of property leaves the conjugal home legal separation marital, parental or property relations other spouse precautionary conditions receivership right to be supported separation in fact sole administrator solidarily liable sufficient community property three months without intention of returning without just cause abandons the other or fails to comply with his or her obligations to the family, the aggrieved spouse may petition the court for administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause, for judicial separation of property or for authority to be the administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause of the absolute community, subject to such administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause as the court may impose.

The spouse who has left the conjugal dwelling for a period of administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause or has failed within the same period to give administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause shall be prima facie presumed to have no intention of returning to the administer or encumberannulled or declared voidany information as to his or her whereaboutsconjugal dwellingconsent of one spousedeathjudicial authorizationjudicial separation of propertyleaves the conjugal homelegal separationmarital, parental or property relationsother spouseprecautionary conditionsreceivershipright to be supportedseparation in factsole administratorsolidarily liablesufficient community propertythree monthswithout intention of returningwithout just cause.
